1. Acceptance of Terms
By accessing or purchasing any courses or services from Skill Up LLC (“Skill Up”, “we”, “our”, “us”), you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.
2. Definitions
- Customer: An individual or corporate entity enrolling in Skill Up courses.
- Learner: A natural person accessing courses for learning purposes.
- Courses: Any digital training, assessments, materials, and associated resources provided by Skill Up.
- Account: User login credentials used to access courses.
- Certificate: Official digital certificate issued upon successful course completion.
- Applicable Law: Laws, statutes, regulations, and rules applicable to Skill Up and its services in the US, EU, UK, or other jurisdictions.
3. Services Provided
Skill Up provides online learning and professional development courses across multiple industries. Services include:
- Self-paced digital courses
- Instructor-led webinars
- Assessments and quizzes
- Digital certification
- Corporate learning dashboards
Courses may be delivered through Skill Up’s LMS or partner platforms.
4. Eligibility
- Users must be at least 18 years old or authorized by a parent/guardian if younger.
- Customers must provide accurate and complete information when registering.
- Corporate Customers confirm authority to enter contracts on behalf of their organization.
5. Account and Access
- Learners are responsible for maintaining account confidentiality.
- Accounts are personal and non-transferable.
- Sharing login credentials or course content is prohibited and may result in termination of access.
6. Payment and Fees
- All fees are payable at the time of enrollment.
- Accepted payment methods include credit/debit cards, PayPal, or approved corporate invoicing.
- Fees exclude taxes where applicable; VAT or other local taxes may apply depending on your location.
- Skill Up reserves the right to correct pricing errors and notify the customer prior to processing.
7. Refunds and Cancellations
- Customers may request refunds only before accessing course content.
- Once a course is accessed or a certificate is issued, the statutory right to cancel may be waived.
- Refunds, if granted, will be processed using the original payment method within 14 calendar days.
- Exceptional circumstances may be reviewed case-by-case at Skill Up’s discretion.
8. Certification
- Certificates are issued upon successful course completion.
- Certificates confirm completion only and do not guarantee employment, legal recognition, or licensing unless explicitly stated.
- Certificates remain the property of Skill Up and may only be used for verification purposes.
9. Intellectual Property
All content, branding, assessments, and certificates remain the intellectual property of Skill Up LLC. Customers and Learners may not reproduce, distribute, or commercialize course materials without written permission.
10. Customer Obligations
- Provide accurate information and comply with instructions to complete courses.
- Do not attempt to bypass course security, manipulate assessments, or alter certificates.
- Corporate Customers must ensure learners follow Skill Up’s policies.
11. Liability
- Skill Up’s liability is limited to the fees paid for the course.
- Skill Up is not responsible for indirect, consequential, or incidental losses.
- Nothing excludes liability for personal injury, death, or fraud.
12. Force Majeure
Skill Up is not liable for delays or failure to provide courses due to events beyond reasonable control, including but not limited to natural disasters, pandemics, acts of government, technical failures, or third-party interruptions.
13. Termination
Skill Up may suspend or terminate access for breach of terms, fraud, misuse, or non-payment. Termination does not affect accrued rights or obligations.
14. Governing Law and Jurisdiction
- Primary governing law: State of New Jersey, USA
- Any disputes are subject to exclusive jurisdiction of New Jersey courts.
- EU and UK consumer protections are respected where applicable for cross-border customers.
15. Notices
All notices must be sent in writing via email ( [email protected] ) or post to the registered address.
Notices are deemed received when delivered during business hours or, if sent outside business hours, when business hours resume.
16. Changes to Terms
Skill Up reserves the right to update these Terms. Continued use of the services constitutes acceptance of the revised Terms.
